By accessing or using Athena Connect's website, services, or products (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services.
2. Services Overview
Athena Connect provides custom NFC (Near Field Communication) business cards, digital business card solutions, and related services. Our products include:
Custom laser-engraved metal NFC business cards
Digital business card platforms and profiles
NFC card programming and customization services
Design and branding services
3. Orders and Pricing
3.1 Order Acceptance
All orders are subject to acceptance by Athena Connect. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.
3.2 Pricing
All prices are in U.S. Dollars and are subject to change without notice. The price charged will be the price displayed at the time of order placement. We reserve the right to correct pricing errors on our website or in orders already placed.
3.3 Payment
Payment is required at the time of order placement. We accept major credit cards, debit cards, and other payment methods as indicated on our website. By providing payment information, you represent that you are authorized to use the payment method.
4. Custom Orders and Design Services
4.1 Design Approval
For custom-designed NFC cards, you will receive a digital proof for approval before production begins. Once you approve the design, changes may not be possible and additional fees may apply for modifications.
4.2 Intellectual Property
You represent and warrant that any designs, logos, images, or content you provide for customization do not infringe on any third-party intellectual property rights. You are solely responsible for ensuring you have the right to use all submitted materials.
4.3 File Requirements
Custom designs must meet our technical specifications. Athena Connect is not responsible for quality issues resulting from low-resolution or improperly formatted files provided by the customer.
5. Production and Delivery
5.1 Production Timeline
Production timelines are estimates only and are not guaranteed. Timelines begin after design approval and payment confirmation. Athena Connect is not liable for delays beyond our reasonable control.
5.2 Shipping
Shipping costs are calculated at checkout. Risk of loss transfers to you upon delivery to the shipping carrier. We are not responsible for shipping delays caused by carriers, weather, customs, or other factors outside our control.
5.3 Delivery Address
You are responsible for providing an accurate delivery address. Athena Connect is not responsible for orders shipped to incorrect addresses provided by the customer.
6. Returns and Refunds
6.1 Custom Products
Due to the custom nature of our products, all sales are final once production has begun. We do not accept returns or provide refunds for custom-designed NFC cards after design approval.
6.2 Defective Products
If you receive a defective product, please contact us within 14 days of delivery. We will replace defective products at no charge if the defect is due to manufacturing error or material defect.
6.3 Non-Custom Products
Standard, non-customized products may be returned within 30 days of delivery in unused condition for a refund minus shipping costs.
7. SMS/Text Messaging Terms (A2P 10DLC Compliance)
7.1 Consent to Receive Messages
By providing your mobile phone number and opting in to receive text messages from Athena Connect, you expressly consent to receive automated marketing, transactional, and informational text messages from us at the phone number you provided. This includes:
Order confirmations and updates
Shipping notifications
Design approval requests
Promotional offers and marketing messages
Account notifications and reminders
7.2 Message Frequency
Message frequency varies depending on your interaction with our Services. You may receive up to 10 messages per month for marketing purposes and additional transactional messages related to your orders.
7.3 Message and Data Rates
Message and data rates may apply. You are responsible for any charges from your mobile carrier. Athena Connect is not responsible for any carrier charges you may incur.
7.4 Opt-Out Instructions
You can opt out of receiving text messages at any time by:
Replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message

Updating your preferences in your account settings
After you opt out, you will receive one final confirmation message. Note that opting out of marketing messages does not opt you out of transactional messages related to orders you have placed.

7.6 Supported Carriers
Our SMS service is available on most major U.S. carriers including AT&T, T-Mobile, Verizon, Sprint, and others. Service may not be available on all carriers.
7.7 No Liability for Messaging Issues
Athena Connect is not liable for delayed or undelivered messages. We do not guarantee that messages will be received, and technical issues or carrier problems may prevent delivery.
7.8 Change of Phone Number
You are responsible for notifying us if you change your phone number or if you no longer wish to receive messages at the number you provided.
8. Privacy and Data Protection
Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy below to understand how we collect, use, and protect your information.
9. NFC Technology and Compatibility
9.1 Device Compatibility
NFC functionality requires a compatible smartphone or device with NFC capabilities enabled. Athena Connect does not guarantee compatibility with all devices or operating systems.
9.2 Third-Party Platforms
Our NFC cards may link to third-party platforms or services. Athena Connect is not responsible for the availability, functionality, or terms of service of third-party platforms.
9.3 Technical Support
We provide reasonable technical support for our NFC products. However, we cannot provide support for third-party devices, applications, or platforms.
10. User Accounts
10.1 Account Creation
You may need to create an account to access certain Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
10.2 Account Security
You agree to notify us immediately of any unauthorized access to your account. Athena Connect is not liable for losses resulting from unauthorized use of your account.
10.3 Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion.

13.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATHENA CONNECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
13.3 Maximum Liability
Our total liability to you for any claims arising from or related to these Terms or our Services shall not exceed the amount you paid us for the product or service giving rise to the claim, or $100, whichever is greater.
14. Indemnification
You agree to indemnify, defend, and hold harmless Athena Connect, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from your use of our Services, your violation of these Terms, or your violation of any rights of another party.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new "Last Updated" date. Your continued use of our Services after such changes constitutes acceptance of the modified Terms.
16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions.
16.2 Dispute Resolution
Any disputes arising from these Terms or our Services shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, conducted in Maricopa County, Arizona.
16.3 Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between you and Athena Connect individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published on our website, constitute the entire agreement between you and Athena Connect regarding our Services.
